Processing of Personal Data Access to any section of the site and/or any requests for information or services on the part of users of the site will be subject to the input of personal data which can be utilized by Barilla G. e R. Fratelli Società per Azioni (hereinafter “Barilla”), as such the Controller of such data who with handle them with respect to current Legislation no. 196/2003 “Code relating to the protection of personal data (hereinafter the “Code”). This notification is intended to inform users of the way in which Barilla processes their personal data before they enter the various areas of the site and provide their personal data. It is necessary however that those users take individual note of this before entering their personal data in the relevant spaces within the various sections of this site. Purposes for which Personal Data is processed According to requests from time to time made by users accessing various sections of the site, the purposes of processing personal data entered directly into online compilation forms will be the following: a) to allow registration on the site, which is necessary to access particular sections of the site itself and to supply and manage the various services on offer; b) provide user consent, until it is revoked, to carry out marketing activities ( meaning simply but not exhaustively, sending promotional publicity material and analysis of registered user access which allows Barilla to improve the services and products on offer to its clients); that is via email, fax, mms and sms, subject to specific consent until such is revoked; c) sending newsletters detailing updates to the site, recipes, menus, advice from nutritionists, and a lot more news of the world of Barilla and the best of Italian cooking (“Subscribe to the newsletter” section of the site);d) reply to users requests in relation to Barilla products, to advertisements, or even to the site ( “Contact us” section of the site). User registration on the site is not required for the performance of some of the services offered by Barilla (e.g. those in the preceding paragraphs c) and d)). However, in order to deal with possible requests from users regarding such services, they are invited to provide personal data, which will only be processed for their relative purposes and for such time as is strictly necessary. Methods of Data Processing Personal data will be dealt with primarily by automated means, and methods strictly related to the aforementioned purposes. Input of users’ personal data The input of personal data is optional but in some parts necessary (that is those details whose boxes are highlighted with an asterisk) in order for Barilla to satisfy users’ functional demands in relation to the site. Missing, inaccurate or partial input of personal data highlighted with an asterisk and necessary for provision of services requested, will result in non–provision of those services; while missing, inaccurate or partial input of optional personal data will have no resulting consequences. Categories of personal data subject to processing In addition to personal details input directly by users (i.e. name, surname, postal/email address, etc.), while in the process of connection to the site, the information systems and software in use by the site itself indirectly acquire some personal data whose transmission is implied in the use of communication protocols via the Internet. Such data are only used in anonymous statistical surveys. Categories of parties who will be privy to users' personal data Employees or collaborators of the Controller’s Marketing Office will be privy to personal data, and operating under the direct authority of the aforementioned Controller, they are supervisors or those in charge of processing such data according to articles. 29 and 30 of the Code and who in that regard will receive the necessary operative instructions; the same will occur – by Supervisors nominated by the Controller- with regard to the employees or collaborators of the Supervisors. Realms of communication or distribution of users’ personal data The personal data provided by users via compilation of online forms will not be communicated to third parties or otherwise distributed, except in the case of displaying on the site the names of any winners of competitions or promotional prizes offered by Barilla via the site. Controller and Data Supervisors The Controller of Data processing is Barilla G. e R. Fratelli Società per Azioni, with offices at 166 Via Mantova, Parma, - 43100; webline@mail.barilla.it. Data Supervisors are: 1) The “Servizio Assicurazione Qualità Barilla“ (Barilla Quality Assurance Service), the Proprietor, in the person of the pro-tem Director of this same Service, concerned with product information of a technical nature; 2) Promoservice S.r.l, with offices at 92 Viale Mentana, Parma, 43100, concerning requests for promotional/publicity information and materials; 3) Fullsix S.p.A., with offices at 40 Corso Vercelli, Milan, 20145, concerning administration and management of the site, and also management of the server on which the site itself is hosted. Rights of Users recognized by Article. 7 of the Code “Article 7 - Right of access to personal data and other rights.1. The interested party has the right to obtain confirmation of the existence or otherwise of relative personal data, even as yet unregistered, and to intelligible communication of such. 2. The interested party has the right to obtain indication: a) of the origin of the personal data; b) of the scope and mode of data processing; c) of the rational applied in case of data processing effected with the aid of electronic equipment; d) of the limits identified by the Controller, the supervisors and designated representatives in the Italian State territory wherever provided; e) of the bodies and categories of bodies to whom the personal data can be communicated, or their existence be made aware to the designated representative of the Italian State territory, supervisors or those in charge of processing. 3. The interested party has the right to obtain: a) updating, moreover rectification, when necessary, integration of the data; b) the cancellation, anonymous transformation or blocking of data managed in violation of the law, including conservation of such unnecessary data in relation to the purpose for which the data were collected or subsequently managed; c) proof that the operations relating to letters a) and b) are confirmed also in regard to their contents and to whom the data have been communicated or distributed, excepting those cases in which fulfilment of such proves to be impossible or implies employment of means overtly disproportionate to the given right. 4. The interested party has the right to object in whole or in part: a) to the processing of relevant personal data for legitimate reasons, even if relevant to the purpose for which it was collected; b) to the processing of relevant personal data with the motive of sending publicity material or direct sales or for the execution of market research or commercial communication.” “The exercise of the above rights can be carried out directly, conferred in writing, by proxy, power of attorney or associations.” Methods of exercising the rights to which Article.7 refers and of acquiring the list of Data Supervisors The user can, in whatsoever moment, exercise his rights according to Article. 7 of the Code as well as acquire the complete list of Data Supervisors by sending an email to the Controller webline@mail.barilla.it, or by posting a letter to: BARILLA G. Additionally the user can, should he wish, object to the data processing for the purposes referred to in letter b) by clicking on the relevant link, thereby sending an email directly from his own address. Means of modifying the user “profile” The user can, whenever he desires, modify the data provided or cancel his profile either by using the site’s appropriate function, “modify data”, or by sending an email to the address of the Controller webline@mail.barilla.it, or by sending a letter to: BARILLA G.
